Case Summary: Our client was operating a moped in the early morning hours when he was violently rear ended by a commercial vehicle operated by an organ transport company. The force of the collision threw him from the moped, causing catastrophic injuries including severe pelvic fractures. He was transported to Wellstar Kennestone Hospital, where he underwent emergency surgery. Despite intensive medical care, he tragically passed away nine days later as a direct result of blunt force trauma sustained in the motor vehicle crash.
The insurance company initially denied liability, claiming their driver could not see the moped due to lighting conditions. After litigation was initiated, the defense shifted tactics and attempted to minimize the value of the case by arguing the decedent’s life was worth less due to his age.
