Who Can File a Wrongful Death Lawsuit in Georgia?

Georgia's 2017 Code, § 51-4-2 defines who can bring a wrongful death lawsuit against another party: 

"The surviving spouse or, if there is no surviving spouse, a child or children, either minor or sui juris, may recover for the homicide of the spouse or parent the full value of the life of the decedent, as shown by the evidence."

The surviving spouse of the decedent can bring a wrongful death suit on behalf of his or her children, but is entitled to at least one-third of any financial recovery received from a wrongful death lawsuit. 

If the decedent has no surviving spouse or children, the decedent's parents or an official representative from their estate can bring a wrongful death lawsuit.
