Case Summary: A family of three was traveling together when an impatient driver attempted to pass them by crossing over the double yellow line on a two lane road for allegedly driving too slowly. During the unsafe pass, the at fault driver sideswiped the family’s vehicle, forcing it into a ditch. The driver also ran off the road, struck a tree, and fled the scene on foot.
Our investigation identified the driver and uncovered evidence that the driver was under the influence at the time of the crash. Despite this, the insurance company denied the claim, arguing the injuries were minor and not worth significant compensation.
We rejected that position and took the case to trial. After presenting evidence of the reckless conduct, DUI, and the impact on the family, we received a $300,000 verdict. This case demonstrates our willingness to try cases and to hold irresponsible and dangerous drivers accountable when insurance companies refuse to do the right thing.
